human hea lth and the even grea ter numbe r of
compositions (if we consider all the bas ic,
skilled, very skilled and prefe rred form ulations
of these crim es) and rec ognizing each of them
is independent, it is un likely to ca rry out a
rational delimitation of each com position
separately from each of the f ollowing , and the
resulting listing in e ach case the totality of
dividing signs (ie the firs t composit ion from
the second, third, fo urth, etc., the second f rom
the third, fourth, fifth, e tc.), because this
method is very cumber some , uneconom ical
and inefficient.
It is more logical to use another m ethod, which
consists in distinguis hing first group con sisted
of crimes a gainst human hea lth, with common
symptom s, and then individual form ulations of
these crime s.
Based on the propose d method, the cr iteria for
distinguishing the c rimes aga inst human health,
or demar cation signs, it is appropriate to
allocate conditionally into three groups:
1) general - a criteria to distinguish betwe en
the maj or groups, including the other , of
crimes;
2) individual - a c riteria to distinguish between
basic and prefe rred formula tions of crimes a nd
offenses provided f or genera l and special
norms;
3) unit - a criteria to di stinguish betwe en basic,
skilled and highly skilled composi tions of the
same ty pe of crime or the qualified and highly
qualified offenses be tween them selves in one
type of cr ime.
Division consider ed the criteria for these ty pes
creates, in m y view, a n opportunity to make a
distinction from the ge neral to the part icular,
and thereby avoid repetition, which ca n hinder
the perception of diff erence s between the
crime.
The genera l criteria for dem arcation of crime s
against human hea lth need to include: a ) the
nature of the har m cause d to human hea lth; b)
the severity of the harm; c ) the form of guilt; g)
the age of the per petrator.
The individual criter ia: a) the fea tures
charac terizing the victim, including his actions
and behavior; b) the for m and conte nt of the
act; c) the situation ( condition) of the c rime; d)
particularly intent; e) The fea tures that
charac terize the special subje ct.
For a single criter ia: a) the particula r objec t of
the crime ; b) the feature s that charac terize the
victim; c) the content of t he ac t; g) the degree
of bodily harm ; d) method of the c rime; e)
charac teristics of guilt, particular ly intent; g)
motive; h) purpose; i) the feature s that
charac terize the special subje ct; k) features
charac terizing complicity in the cr ime.
The presence of a diffe rentiating feature
necessitates the applica tion of crim inal law,
which provided for th is feature.
From the genera l criteria spec ified delineation
first two charac terize the objec tive side, the
third - the subj ective side, and the four th - the
subject of the c rimes in question.
The first comm on criterion - the nature of the
harm ca used to human he alth, - allows to
distinguish betwee n offenses in which the
result is expressed i n the form of injuries,
consisting of violatin g anatomic integr ity of
organs and tissues a nd their phy siological
functions or disease except STD and HI V
infection or pathologica l condition r esulting
from exposure to various environme ntal
factors: me chanical, phy sical, chemica l,
biological, psyc hic. In other words, a llocated
offenses descr ibed in the article. 111 - 11 5,
117, 118, h. 3 tables poons. 123 and Ar t. 124 of
the Criminal Code, a nd offenses in wh ich the
result is expressed in dise ase vener eal disease
or HIV infection re sulting from e xposure to
biological fac tors of the environme nt (they a re
provided by Art. 121, c h. 2, 3, 4, Art. 122 of
the Criminal Code) .
